At Shaolin Hub, we are committed to respecting and protecting intellectual property rights. This policy outlines our approach to handling intellectual property concerns and ensuring that our platform remains a safe and respectful marketplace for buyers and sellers alike.

1. Respect for Intellectual Property

Shaolin Hub prohibits the sale, listing, or promotion of products that infringe on intellectual property rights, including but not limited to copyrights, trademarks, patents, and trade secrets. Sellers are required to ensure that their products comply with all applicable laws and regulations.

2. Reporting Intellectual Property Infringements

If you believe that your intellectual property rights have been infringed upon by a listing or product on Shaolin Hub, you can submit a claim using the following process:

A clear description of the alleged infringement.

Evidence of your ownership of the intellectual property (e.g., registration certificates, legal documentation).

Good Faith Declaration:

Include a statement that your report is made in good faith and that you have a legitimate belief that the reported content violates your intellectual property rights.

3. Response to Infringement Claims

Upon receiving a valid intellectual property infringement report, Shaolin Hub will:

Acknowledge receipt of the report and review the submitted details.

Temporarily remove or disable access to the allegedly infringing content.

Notify the seller or user responsible for the content about the claim and provide them with an opportunity to respond.

Take appropriate action based on the findings, which may include permanently removing the content, suspending the seller’s account, or resolving the issue through other means.

4. Counter-Notification Process

If you are a seller whose listing was removed due to an intellectual property claim and you believe the claim is unfounded, you may submit a counter-notification:

1. Contact Information:

Email: ip@shaolinhub.com

Subject line: "Counter-Notification: Intellectual Property Claim"

2. Provide Detailed Information:

Your full name and contact information.

Identification of the removed content (e.g., product URL, listing ID).

A statement explaining why you believe the claim is invalid or mistaken.

Any supporting documentation proving your rights to the content.

3. Declaration and Signature:

Include a statement made under penalty of perjury that your counter-notification is accurate and that you have a good faith belief that the content was removed in error.

Provide your electronic or physical signature.

Shaolin Hub will review the counter-notification and may reinstate the content if the claim is deemed invalid. We may also notify the original claimant of the counter-notification and provide them with the opportunity to respond or take further legal action.

5. Consequences of Violations

Violations of our Intellectual Property Policy may result in:

Immediate removal of the infringing content.

Account suspension or termination.

Legal action by the intellectual property owner.

Repeat violations may lead to permanent account bans and restrictions on accessing Shaolin Hub’s services.

6. Educational Resources

Shaolin Hub encourages sellers to educate themselves about intellectual property rights to avoid violations. Sellers can access helpful resources through government and legal organizations or consult an intellectual property attorney for guidance.
